1. COPYRIGHT:

  The copyright Designs and Patents Acts assign the copyright of the images to the photographer.  

2. DISPLAY:

  The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.  Special requests are not binding instruction, although every effort is made to comply with the client's wishes.  Equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.

3. PERSONAL INJURY:

 Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents/injuries during a photographic shoot.

 

4. PAYMENTS / CANCELLATION:

  A refundable* deposit fee of 50% will confirm your event booking and remove that date from our availability calendar.  It also acts as full acceptance of the terms and conditions listed above. The booking fee will be deducted from the final balance due which will be collected by the photographer (or agent) on the day of the event or upon receipt of proofs and master files.

* A 50% refund of the deposit fee will be provided to any client that cancels our contract(s) when there is more than one calendar year until the contracted event date.  A 25% refund of the deposit fee will be provided to any client that cancels our contract(s) when there is more than nine months and less than twelve months remaining until the contracted event.  A 10% refund will be provided to any client that cancels our contracts when there is more than six months remaining but less than nine months until the contracted event.  No refund will be provided when there is under six months remaining until the contracted event.  In the event the contracted client cancels the event (for any reason) with less than three months remaining until the contract event, the contracted client agrees to pay the photographer 100% of the contract price.

The photographer retains the right to offer the contracted client the ability to use the deposit fee/remaining deposit fee (using the above formula) for a future agreed upon date.  This is solely at the discretion of the photographer.  

FORCE MAJEURE:

In the very unlikely event of cancellation by the photographer or of total photographic failure, liability shall be limited to a full refund of any fees paid by contracted client.
